These Terms of Service govern your use of Waypod delivery management services provided by Ghouer (Pty) Ltd (“we”, “us”, or “our”). By using Waypod, you agree to these Terms.
By accessing or using Waypod, you agree to be bound by these Terms of Service and all policies referenced herein (collectively, the “Terms”). If you do not agree, do not use Waypod.
You must provide accurate information and keep your account secure.
You are responsible for all activity under your account.
We may require identity or eligibility verification for certain features.
Paid features are billed in advance on a subscription basis unless otherwise stated.
Fees are non‑refundable except where required by law.
We may change prices with prior notice. Continued use after changes constitutes acceptance.
No unlawful, infringing, or harmful activities.
No attempts to disrupt, reverse engineer, or bypass security or usage limits.
No uploading of malicious code or content that violates others’ rights.
You retain ownership of your content. You grant Waypod a limited license to host, process, and display content solely to provide the services. You are responsible for obtaining necessary permissions for content you submit.
Waypod, its logos, and all related product names are trademarks or service marks of Waypod or its licensors. All rights are reserved. You may not use our marks without prior written permission.
Waypod may integrate with third‑party products (including WhatsApp Business API). Their terms and privacy policies apply to your use of those products. We are not responsible for third‑party services.
Each party agrees to protect the other’s confidential information and to use it only as necessary to provide or receive the services under these Terms.
Our Privacy Policy explains how we collect and process personal data. By using Waypod, you consent to those practices.
Waypod is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
To the maximum extent permitted by law, Waypod and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities.
You agree to indemnify and hold harmless Waypod, its affiliates, and personnel from any claims arising out of your use of Waypod, your content, or your violation of these Terms.
We may suspend or terminate access if you violate these Terms or if required for security, legal, or operational reasons.
You may stop using Waypod at any time.
These Terms are governed by the laws of South Africa, without regard to conflict of laws rules. Venue for disputes shall be the competent courts within South Africa, unless otherwise required by law.
We may update these Terms from time to time. We will post the updated version and revise the “Updated” date above. Continued use of Waypod after changes become effective constitutes acceptance.
